Let me begin by saying I’m sorry I will not be able to attend the August 28 meeting. Not seeing it on the agenda I planned a trip out of the country. I will be out of the country on the 28th of August.
As I mentioned to you at the last meeting, I am a full-time resident of PALM BEACH. I do leave during some of the summer for some cooler weather in New Jersey.
I know you have on hand a copy of the “protective agreement” for 336 E. and 336 W. Australian Ave.
I’d like to draw your attention to paragraph five of the protective agreement
“ neither unit owner shall replace the vegetation of the property which shall cause his or her vegetation to be disproportionate with the vegetation of the other unit owners property.”
This agreement also controls the color of the residence in paragraph two…
“ neither townhouse unit owner shall in anyway change the color of the exterior of his or her townhouse”.
Regarding the Ficus…
I understand how the town is desirous of reducing the ficus in town, but I must tell you that the ficus certainly along the sidewalk in the front of the house is healthy and is a critical part of the character of the two homes. It was one of the very attractive features that led us to buy our unit from Julie Aristog.
If and when that front sidewalk ficus becomes unhealthy and severely damaged…then I understand that we should replace the same with Privet shrubs.
The demising ficus shrubs that run from the front of our homes north and south …in an effort to cooperate with our neighbor, the Loeb’s , we will accept her desire to build a wall and shrub our side of the wall at her cost and expense with Privet shrubbery.
We have agreed to her placing a concrete wall in the rear of the property going north and south demising our backyards at her expense, planting privet shrubs on our side covering the wall.
As I mentioned at the last meeting we have been in a war zone for the past going on three years being the neighbor of the Loeb’s . I would suggest that we first do the rear yard and evaluate our timeliness of the construction/ planting before we do anything in the front yard so as not to disrupt the upcoming season.
If the rear construction/planting can be completed in 30 days and prior to the end of September, then we will agree to the same schedule in the front yard with completion by the end of October.
If the rear wall and shrubbery are not completed by the end of September as stated above, then I would ask that you all not permit any construction in the front yard to begin until next end of next season.
