    Dear ARCOM members,
    My wife and I are writing to address our concerns and comments regarding the project at 1150 N Ocean Way. We live at 210 La Puerta Way along the north boundary line of the proposed project. We have included a photo showing a southern view from our rear yard.
    First, let me begin by saying that we appreciate the consideration and changes made to this project by Mr. and Mrs. Burns and their architects. We are however, still concerned about the proximity of this project to our lot line and its impact on our privacy. Our request would be to move the two story sections of the building southward as far as possible or at least to 19’-1 1/2” as previously proposed at the February ARCOM meeting. Additionally, we would like to see the two north facing balconies removed or alternatively, have access to them restricted by non-functional doors or windows. The current building plan would put the balconies within 13 feet of our property.
    If these suggested changes could be made we feel that this would be a reasonable compromise. We would like to thank the ARCOM committee for their consideration of our concerns.

    Dear ARCOM Members:
    I am writing on behalf of myself and my wife, Carrie, to express our opinions regarding the most recent plans for the proposed residence at 1150 North Ocean Way (the “Project”) to be considered at the March 27, 2024 ARCOM meeting. Carrie and I live at 200 La Puerta Way, which lies due north of the Project and shares a boundary with the Project.
    We are encouraged by the most recent revisions to the plans, which incorporate many of the suggestions made by Commissioners at the February 28, 2024 meeting. In particular, the reconfiguration of the second story elements reduces the burden on our property and that of Mary and David Carlino, who own the other property on northern boundary of the Project. Ultimately, with the two proposed changes outlined below, we believe that the Burns family will have a beautiful home that is in harmony with the neighborhood and protects the privacy of the neighbors.
    First, we believe that the second story structures should be shifted to the south. We do not object to the first story element being built on the setback line, but believe that the second story element should be moved off the setback line to protect our privacy interests and to reduce the massing. To remind the Commission, here is the current view from our property looking in the direction of the Project:
    The north façade of the Project will be directly over our pool. For this reason, we request that the Commission request that the owner move the second story element as far to the south as possible.
    Second, the current plan for the Project includes second story balconies on the north side. These balconies extend beyond the setback line towards our property. We believe that to protect our privacy, this Commission should request that the balconies on the north side be eliminated and replaced by windows.
    Again, we are grateful that ARCOM has heard our concerns and has been sympathetic with the burdens that the previous plans for the Project placed on our property. We are encouraged that the owners of the Project considered and incorporated the input of this Commission made during the February meeting. We believe with the two changes proposed in this letter the Project will meet the criteria of Section 18-205 of the Town Code. Accordingly, we request that ARCOM defer the Project so that the two changes proposed in this letter can be incorporated into the Project.
