HSB-24-001 311 PENDLETON LN. The applicant, Starr Haymes Kempin for Pendleton Lane Trust has filed an application requesting a Certificate of Appropriateness review and approval for a modified front entry, addition of shutters, relocation of a few windows in addition to hardscape modifications changing the driveway and reducing the paver pool deck to an existing two-story historically significant building.

Please be advised that my clients continue to object to the modifications made to 311 Pendleton Lane as set forth in their original attached correspondence. As you will recall all but one of the neighbors objected (and still object) to a second curb cut and circular driveway. At the same time, my clients in good faith do not recall receiving any notice prior to the March of 2023 meeting in which a prior plan was apparently approved. Unfortunately, Certified Mail may not have been required at the time.
In light of the situation, it appeared clear to my clients at the January meeting that the Commission was not inclined to proceed or approve any modifications to the hardscape or landscape until after the Applicant had met with the neighbors, walked the area, heard their objections, and discussed if there was a way to preserve the single side driveway. This never happened. As set forth in the attached e-mail on Efforts to Reach Out to Neighbor Mr. Sieving reached out to the Applicant’s representatives on several occasions but got no response from the Applicant. As a result, the neighbors would request that the Commission take no further action on this project at this time, leaving the Applicant with exactly what was approved in March 2023 and no more.
