ZON-23-020 (COA-23-003) 139 N COUNTY RD—THE PARAMOUNT THEATER (COMBO)—SPECIAL EXCEPTION WITH SITE PLAN REVIEW AND VARIANCES The applicant, WEG Paramount LLC, has filed an application requesting Town Council review and approval for a Special Exception with Site Plan Review for the renovation of an existing Landmarked theater structure and the construction of a new three-story mixed use (retail and four residential units) development including Special Exception requests (1) to permit Private Club use in the C-TS district, (2) for square footage greater than 3,000 SF in the C-TS district, (3) for Outdoor café seating use associated with a private club in the C-TS district, (5) for two stories in the C-TS district, (6) for shared parking in the C-TS district, and (7) for a modification to a previously approved Special Exception for Churches, synagogues or other houses of worship to allow for a flexible event space. The applicant is also seeking Site Plan Review for new building(s) or for changes in a permitted use in Sec. 134-1107 which involve more than 2000 square feet of building floor area in the C-TS zoning district. Additionally, the applicant is seeking review and approval for Variances (1) to reduce the required front yard setback, (2) front side street yard setback, (3) and to reduce the required rear yard setback requirements for new construction, (4) to allow three stories in lieu of two stories in CTS district, (5) to exceed the maximum height, (6) to exceed the maximum overall building height, (7) to exceed the maximum allowable lot coverage limitation, (8) to exceed the maximum building length permitted, (9) to exceed the maximum building size (floor area) permitted, (10) to reduce the require overall landscape open space, (11) to reduce the required front yard landscape open space, (12) to reduce the required front yard setback for the subterranean parking level, (13) to reduce the front side street yard setback for the subterranean parking level, (14) to permit mechanical lift parking in the parking garage, (15) a variance to exceed the maximum height of a perimeter wall on a side or rear property line, (16) to permit residential uses on the first level in the C-TS zoning district in lieu of the above the first-floor requirement, (17) to allow generators on a roof(s), (18) to exceed the maximum height of a screening wall for mechanical equipment on a roof, (19) to exceed the maximum height of mechanical equipment on a roof, and (20) to exceed the maximum height of chimneys, in conjunction with the renovation and adaptive reuse of an existing Landmarked theater structure and the construction of four connected residences with ground floor retail components with two levels of subterranean parking. The Landmarks Preservation Commission will perform the design review.

As I stated in my public comment from January's meeting, since the 1970s I have resided on both Sunrise and Sunset Avenues, so I am very familiar with these street blocks and parts of Town.
The Paramount project as outlined is incredibly oversized and the requested occupancy figures alone must be non-starters. It is undeniable that the Sunset / Sunrise / Royal Poinciana / N. County / Bradley roadways are so beyond capacity that the Town's very modern, expensive and newly-installed traffic management technology can't keep up with the volume of vehicles and trucks that smother these roadways. In fact, this was stated on the record just yesterday, during the March 12th Town Council meeting by the Town's Public Works Director, Chief of Police, and the Kimley-Horn engineering consultant, as the official diagnosis of why the functionality of these roadways and intersections so suddenly deteriorated this season.
The Town Council cannot possibly consider approving a project that would so obviously intensify and bombard an already gridlocked part of Town, especially a mere day after the Town's traffic experts sounded the alarm about the very intersections that will bear the brunt of the Paramount project's negative impacts. Approving the Paramount project, in its current state and at this current time, would do a great disservice to all the time and taxpayer resources that have been spent on the Town's yet-to-be-finished traffic study - a study that we hope will be full of action items and desperately needed solutions. We cannot allow developers to contest the Town's officially commissioned studies and experts. If we bow to such attempts, there is no point in commissioning these studies in the first place.
The Town must first find solutions to its existing problems that impact residents. Only after those have been solved can the Town then entertain the fanciful plans of developers.

I am a resident and property owner on the 100 block of Sunset ave . One of my concerns with the proposed development is that it will exacerbate the current traffic issues on Sunset, North county and Sunrise avenue .
These intersections are in gridlock from mid afternoon thru early evening. The change making the 200 block of Sunset ave one way east has had the unintended cosequence of directing even more traffic into the Sunset and North County intersection. The current Paramount plans calls for the addition of 475 member private club ( maximum occupancy 412) which will only increase density and traffic congestion .
The area currently has significant retail space, Public’s and 10 restaurants ( listed below) within 1.5 Blocks of the Paramount. (PB catch , Echo, Almond , Greens , Flagler Steakhouse , Cucina, Henreys , Field of Greens , Lola and Trivini. The area is now densely residential with large buildings including the Sun and Surf and the Leveritt house.
In addition the Theather and waterfront restaurant being developed in Royal Poinciana Plaza has the potential of adding significant event and dining traffic to the area , especially with the limited parking in the Plaza.
The ability of emergence vehicles to access and leave the area and north end also needs to be taken into account.
I hope my input is useful and you will make decisions that will not further increase congestion in our area.
