8. ARC-23-145 (ZON-23-113) 123 CHILEAN AVE (COMBO). The applicant, Robert & Perri Bishop, has filed an application requesting Architectural Commission review and approval for construction of a new two-story single-family residence and one-story accessory cabana structure with final hardscape, landscape and swimming pool, requiring Special Exception approval to develop a nonconforming parcel and variances to reduce the required side setbacks and to exceed the maximum cubic content ratio (CCR) permitted. This is a combination project that shall also be reviewed by Town Council as it pertains to zoning relief/approval.

    Dear Sir or Madame,
    I am a resident of 360 South Ocean Blvd, which shares a West property line with 123 Chilean. I understand that one of the many variances requested is a proposed 10’ setback instead of 15’ from our mutual property line.
    I object in the strongest of all possible terms to this, as do all of the residents of our building. This creates mechanical noise literally beside our pool and also increases the noise level on the west side residents terraces. It also will place parts of the pool in the shade for much of the day.
    Please deny this variance. When the buyers bought the property at 123 Chilean, they were advised of the constraints placed upon them as they contemplated building this oversized home on a moderately sized lot.

    Hello,
    It has come to my attention that there is a variance being asked for at 123 Chilean. The variance asks for 2 things. Firstly to be closer to the neighboring property. It would be too close to the neighboring pool which services many residents. It would also severely reduce the time the pool would enjoy sunshine. The building has many elderly residents and it is the only space they can sit in safely. The variance also asks to be higher than the house that existed before. I think it would ruin the look of the street as many others are lower. We do not need more construction and bigger we need remodeling in the existing footprint otherwise we will start to look overbuilt and over crowded. Respectfully please deny both for the sake of maintaining our lovely community.

    Jarrett Kling. Resident of 360 South Ocean Blvd, Palm Beach, FL 33480. I oppose the application to reduce the setback from 15’ to 10’. Our pool area would be subject to noise from the pool equipment and the generator. Also the reduced space would reduce the privacy of our pool area. Thank you. Jarrett Kling

    I am a resident of the Dunster House at 360 S Ocean Blvd. Our West property line is adjacent to this property, in particular our pool area is quite close. The requested setback variance change is something that I and our entire building object to, as it places the proposed mechanicals for 123 Chilean 10 feet away from our pool (instead of 15 feet), creating a noise nuisance forever to both our pool area and the terraces on the west side of our building. Please deny this variance. Thank you.
